Stephen Kohn is one of the most eminent whistleblower lawyers in the United States, perhaps best known for having successfully defended Linda Tripp when she blew the whistle on the famous Clinton-Lewinsky sex scandal. Kohns interest has now turned to Malta and has personally urged Prime Minister Joseph Muscat and the Council of Europes anti-corruption body GRECO to protect a whistleblower who has alleged severe shortcomings at the Malta Gaming Authority.
TotallyHackedOff: Robin- sorry to hear of your dealings with Shell. I too had considered reporting an issue to the tell shell line but was put off by outsiders who had said that whistleblowing never ends well for the whistleblower. And I guess their advice was right. However it made no difference to me as I lost my job anyway and now with hindsight I wished Id had reported it just so as to get the bloody bean counters and Human Remains department to do some work for a change. Anyway, if they treated you like that, your better off out of Shell. You sound like you are more upstanding then them and actually have principles. Dust yourself off and get back on that wagon. Forget about for Shell although I am sure it feels pretty raw right now. Time will make it better.. It identifies former Monaco spymaster Robert Eringer as the most likely ...
A growing majority of Americans have figured out that our government doesnt trust us, lies to us constantly, and is populated by power-mad functionaries who hate liberty and hate the country as founded.. The Environmental Protection Agency (EPA) has become the latest example of this.. Whistleblowers claim the agency has been lying on risk assessments regarding dangerous new chemicals in order to downplay their risks so they can be more quickly approved for use by companies that donate to the elected leaders in charge of EPA oversight, The Guardian reported this week.. The outlet noted:. Over the past five years, the EPA has not rejected any new chemicals submitted by industry despite agency scientists flagging dozens of compounds for high toxicity. Four EPA whistleblowers and industry watchdogs say a revolving door between the agency and chemical companies is to blame, and that the programs management has been captured by industry. The charges are supported by emails, documents and ...

October 19, 2016. Thomas Frieden, the director of the Center for Disease Control (CDC), has blocked CDC whistleblower, Dr. William Thompson, from testifying on scientific fraud and destruction of evidence by senior CDC officials in critical vaccine safety studies regarding the causative relationship between childhood vaccines and autism.. Attorneys Bryan Smith and Robert F. Kennedy, Jr., of Morgan & Morgan, have been seeking to have Dr. Thompson testify in a medical malpractice case to explain how the CDC committed scientific fraud in a series of studies, which found no link between vaccines and autism.. In denying the request, Dr. Frieden said, Dr. William Thompsons deposition testimony would not substantially promote the objectives of CDC or HHS [Health and Human Services].. Dr. Thompson, a 19-year veteran at the CDC and former senior vaccine safety scientist at the agencys Immunology Safety Office, is the co-author of four key studies that the CDC widely touts to exonerate the MMR vaccine ...
In a shocking interview just published yesterday by Project Veritas, a whistleblower who allegedly works in federal law enforcement within the Department of Homeland Security, has stated that known criminal gang members who are listed with Transnational Criminal Organizations and are on government watchlists, are not only being allowed to cross the border and come into the United States, but they are being issued Employment Authorization Cards by simply stating that their lives are in danger if they are forced to return to their countries. He states that ALL of these Transnational Criminal Organizations are involved in child sex trafficking. So we now know that the U.S. is issuing work permits to known criminals who are sexually trafficking children coming across the border. And we can add to that the fact that some of these criminals with a past record of child sex trafficking who have been sitting in U.S. prisons are now being released into the public again, all in the name of COVID. How is
At Least 13 Women at Monte Vista Plant Physically and Verbally Abused and Three Fired for Refusing to Submit or Complaining, Federal Agency Charged. DENVER - Two potato packing companies will pay $450,000 and furnish other relief to settle a lawsuit for sexual harassment and retaliation brought by the U.S. Equal Employment Opportunity Commission (EEOC), the federal agency announced today.. EEOC charged Smokin Spuds, Inc., d/b/a MountainKing Potatoes, and Farming Technology, Inc., d/b/a MountainKing Potatoes, which operate a potato packing plant in Monte Vista, Colo., with violating federal law by subjecting more than a dozen women to regular verbal sexual harassment and unwelcome physical contact from a supervisor. EEOC also claimed that the companies unlawfully discharged three of the women in retaliation for refusing to submit to the harassment or making complaints about the harassment to other management officials.. According to EEOCs suit, supervisor Samuel Valdez engaged in various ...
In a recent story that no mainstream media outlet reported, a Pennsylvania federal judge ruled in favor of whistleblowers who have accused Merck of lying about the efficacy of its mumps vaccine (currently only available in combo with MMR). We had to find this story posted on a couple of websites representing lawyers. The lawsuit is brought by two whistleblowers, virologists who worked for Merck and are accusing Merck of lying about the effectiveness of the mumps vaccine. This story did garner mainstream news coverage back in 2012, before Mercks attorneys appealed and tried to get the case thrown out of court. This week, U.S. District Judge C. Darnell Jones II ruled that the whistleblowers had sufficiently pled that Merck might have provided false statements to the government and that the direct purchasers had shown enough evidence to establish that these falsehoods could have helped the company gain a monopoly. It is certainly understandable why the mainstream media does not want to touch this ...
China is warning of retaliation in response to a visit to Taiwan by a Czech Senate delegation, saying Senate President Milos Vystrcil crossed a red-line and violated the one-China principle under which Beijing asserts sovereignty over the island.. As part of the business trip, which ended Friday, Vystrcil delivered a speech in Taiwans parliament and met with President Tsai Ing-wen. China said Vystrcils visit was an open provocation, with Foreign Minister Wang Yi warning that Vystrcil would pay a heavy price. The threat led to criticism from European Union leaders. China considers Taiwan a renegade province.. Analysts in the Czech Republic say actions taken by China, if any, may include freezing diplomatic ties with Prague, liquidating China-owned stakes in several Czech companies and restricting Prague-bound Chinese tourists.. They said such action will have a limited impact on the Czech economy given its low dependence on Beijing, yet, may trigger a concerted response from some other ...
Effects of sexual harassment can vary depending on the individual, and the severity and duration of the harassment. Often, sexual harassment incidents fall into the category of the merely annoying. However, many situations can, and do, have life-altering effects particularly when they involve severe/chronic abuses, and/or retaliation against a victim who does not submit to the harassment, or who complains about it openly. Indeed, psychologists and social workers report that severe/chronic sexual harassment can have the same psychological effects as rape or sexual assault. (Koss, 1987) For example, in 1995, Judith Coflin committed suicide after chronic sexual harassment by her bosses and coworkers. (Her family was later awarded 6 million dollars in punitive and compensatory damages.) Backlash and victim-blaming can further aggravate the effects. Moreover, every year, sexual harassment costs hundreds of millions of dollars in lost educational and professional opportunities, mostly for girls and ...
BEIRUT (AP) - The leader of the militant Hezbollah group said Saturday his group will retaliate against any future Israeli airstrikes on Lebanon, a day after his supporters fired a barrage of rockets toward Israel.. Hassan Nasrallah said it would be wrong to assume Hezbollah would be constrained by internal divisions in Lebanon, or the countrys harsh economic crisis.. Nasrallahs comments came a day after his group fired rockets toward Israel, calling it retaliation for Israeli airstrikes on southern Lebanon a day earlier.. Thursdays airstrikes - the first in years - were in response to mysterious rockets that were fired from Lebanon toward Israel on Wednesday.. Fridays rocket fire was the third day of attacks along the volatile border with Lebanon, a major Middle East flashpoint where tensions between Israel and Iran, which backs Hezbollah, occasionally play out.. Any airstrike by Israels airforce on Lebanon will be retaliated in a suitable way because we want to protect our country, ...
Background: Litigation documents reveal that pharmaceutical companies have paid physicians to promote off-label uses of their products through a number of different avenues. It is unknown whether physicians and scientists who have such conflicts of interest adequately disclose such relationships in the scientific publications they author. Methods and Findings: We collected whistleblower complaints alleging illegal off-label marketing from the US Department of Justice and other publicly available sources (date range: 1996-2010). We identified physicians and scientists described in the complaints as having financial relationships with defendant manufacturers, then searched Medline for articles they authored in the subsequent three years. We assessed disclosures made in articles related to the off-label use in question, determined the frequency of adequate disclosure statements, and analyzed characteristics of the authors (specialty, author position) and articles (type, connection to off-label use, ...

July 20, 2012. Countrywide Financial was one of the subprime lenders at the heart of the financial crisis; its predatory lending practices resulted in disgustingly large payouts for executives while sticking low-income borrowers with explosive mortgages they hadnt a hope of paying back. The New York Times Gretchen Morgenson called Countrywide, Exhibit A for the lax and, until recently, highly lucrative lending that has turned a once-hot business ice cold and has touched off a housing crisis of historic proportions.. Eileen Foster was an investigator in charge of Fraud Risk Management at Countrywide when the ticking time bomb of its bad loans detonated. The practices she discovered shocked her and have also shocked those whove heard her story-including the producers of 60 Minutes, who asked her on the program last December to discuss the lack of prosecutions of any of the bankers responsible for the crisis. But instead of cleaning house and admitting guilt, Bank of America-which purchased ...

This resolution is part of the governments emphasis on combating health care fraud and another step for the Health Care Fraud Prevention and Enforcement Action Team (HEAT) initiative, which was announced by Attorney General Eric Holder and Kathleen Sebelius, Secretary of the Department of Health and Human Services in May 2009. The partnership between the two departments has focused efforts to reduce and prevent Medicare and Medicaid financial fraud through enhanced cooperation. One of the most powerful tools in that effort is the False Claims Act, which the Justice Department has used to recover more than $6.7 billion since January 2009 in cases involving fraud against federal health care programs. The Justice Departments total recoveries in False Claims Act cases since January 2009 are over $9 billion ...

The US Congress previously examined problems in The SEED [ix] [x] [xi] and then in later residential treatment programs. These later substance abuse treatment programs were modeled on the Synanon program, [xii] [xiii] [xiv] [xv] [xvi] [xvii] the SEED and Straight Inc. Each time, the offending substance abuse treatment program was shut down. However, new programs rapidly emerged with new legal identities to start the same kind of operation. There are now even more programs reported to be abusive, despite numerous local, state and federal investigations. Those who have been victimized in one of these facilities are frustrated and dismayed to realize that not even several US Congressional investigations can prevent the recurrence of the same kind of abuse. Although Straight Inc. programs were closed, the governing principles remain a model for drug rehabilitation. It is a national disgrace that the abuse of children in residential centers has not stopped. Rather, governmental sanction hides its ...
Each monthly edition of WNDs popular Whistleblower magazine tackles a single topic - a controversial, often explosive, and almost always politically incorrect topic, but one of immense importance to the lives of Americans. Recent issues have focused on: The United Nations; the destructive nature of government schools; the gay rights movements secret agenda; abortion; and the radical environmentalist movement. RELATED: JUDGES GONE WILD! The current issue, titled KILLER CULTURE, focuses on Americas increasingly bizarre youth culture - pierced, tattooed, and hyper-sexualized. If youve ever wondered why obscene rap music and gangland clothing, extreme body modification, every type of sexual experience, drug abuse and other harmful behaviors have taken such a powerful hold on todays young people - and at progressively younger and younger ages - Decembers Whistleblower has some alarming answers. ...

In the ensuing weeks she resolved to act. She intended to find another job and, on her last day, confront Jeff Skilling with her evidence. But Skilling beat her to it. He left on 14 August 2001. It was this that spurred Watkins into action. On August 15 she sent an anonymous letter to Lay. The very next day I identified myself and set up a meeting for the following week with him, she says. At that meeting Lay asked for time to investigate. Thats pretty much the last I saw of him, Watkins says.. Events were about to get significantly worse. About a dozen people knew about the memos before then and Watkins was thrown theres-the-evil-one stares whenever she passed them in the corridor. Fastow, meanwhile, tried to get her fired.. But by now there were other priorities. October 16 was when Enron announced their rather questionable write-offs, Watkins says. The stock was trading at $33 a share and within six weeks it was at 9 cents a share and the company was declaring bankruptcy on ...

Findings-2019 c 349: The legislature finds that workplace harassment remains a persistent problem and there is an urgent need to address barriers that prevent people from reporting harassment. The United States equal employment opportunity commission select task force on the study of harassment in the workplace released a report in 2016 finding that ninety percent of individuals who experience harassment never take formal action, and noting that seventy-five percent of employees who spoke out against workplace mistreatment faced some sort of retaliation. The legislature finds that it is in the public interest for state employees to feel safe to report incidents of harassment when it occurs and to protect these employees from an increased risk of retaliation. The legislature finds that the release of the identities of employees who report or participate in harassment investigations increases the risk of retaliation, invades the privacy of a vulnerable population, and significantly reduces ...

Last month, a number of allegations were made against GitHub and some of its employees, including one of its co-founders, Tom Preston-Werner. We took these claims seriously and launched a full, independent, third-party investigation.. The investigation found no evidence to support the claims against Tom and his wife of sexual or gender-based harassment or retaliation, or of a sexist or hostile work environment. However, while there may have been no legal wrongdoing, the investigator did find evidence of mistakes and errors of judgment. In light of these findings, Tom has submitted his resignation, which the company has accepted. Tom has been a huge part of this company from the very beginning and we appreciate all that he has done for GitHub. We wish him the best in his next endeavour.. As to the remaining allegations, the investigation found no evidence of gender-based discrimination, harassment, retaliation, or abuse.. We want to create a great place to work for all our employees and we cant ...

Fred Williams: They decided that they were going to stand out and protest-protest the food, protest health service, protest the ventilation, protest the living conditions overall. And so, these few guys stood outside, walking in circles, protesting, chanting, you know, Equal work, equal pay, chanting. And they were also calling for other guys inside the housing units to come out and stand with them in solidarity. And it worked. They walked in circles in the common area, chanting, and the crowd just grew larger and larger and larger, until the point where, when I looked out the window, it looked like it was maybe 500-600 guys out there. And so, the ERT was called in; the emergency response team was called in. It took four or five hours. And from what I understand, this is either the first or second time the government allowed for live ammunition to be entered onto the prison compound in Michigan.. ...
Whats wrong with preemptive war, exactly? Whats new about it?. All wars are preemptive. Wars cost lives and money, and can only be justified to preempt the presumably worse damage of not going to war. One of the lessons of the 20th century is that a little more preemption would have saved a good deal of cure. How much better off might we be had the Allies stamped out the Russian Bolsheviks in 1918 instead of sending in an inadequate force with instructions to twiddle their thumbs? Or if we had listened to Patton and marched on Moscow in 1945? Wouldnt it have been nice to wipe out Al-Qaeda before 9/11?. The anti-preemptionists (is that a word?) often speak of proportion and retaliation, as if the purpose of war were to balance the scales of cosmic justice - you killed one of mine, Ill kill two of yours now. Retaliation has no more place in war than it does in criminal justice. The trouble with waiting to be attacked is that it permits the aggressor to choose when to start the war. If a ...
Hostile Environment Sexual Harassment means unwelcome sexual advances, requests for sexual favors, or other verbal or physical conduct of a sexual nature is so severe, pervasive, and/or objectively offensive that the conduct unreasonably interferes with the Reporting Partys employment, academic pursuits, or participation in University activities (i.e. the conduct creates an objectively hostile environment). Generally, a single inappropriate joke, unwelcome sexual advance, or unwelcome request for sexual favors does not create a hostile environment; however, being subjected to such conduct repeatedly may constitute a hostile environment. In determining whether the alleged conduct warrants corrective action, all relevant circumstances, including the context in which the conduct occurred, will be considered. The existence of a hostile environment will be determined on the basis of what is reasonable to persons of ordinary sensitivity and not on the particular sensitivity or reaction of an ...

The competitors appear in advanced levels, and each has a different strategy: some concentrate in the real estate market, others in trade or in resource production.. DESIRABILITY. When new structures get built, these can differ in desirability. Usually this depends on what is present (or built) around them. For example a patrician villa has higher desirability (and hence higher market value) if nearby there are gardens, fountains, other villas, theatres.. It instead loses value if nearby there are stables, farms, wheat fields… Residents will at first go to dwell or work in the structures with higher desirability, avoiding those of little value.. For production structures, for example a wheat field, the value depends on the amount of the produced resource is available in the nearby city and in the global market. If the market needs grains, the value of the field will rise. Conversely, the field would become less desirable and its value decrease.. DAMAGE. In time, structures deteriorate. Every ...

Airbnbs policy and public affairs head Chris Lehane launched into an impassioned diatribe on Tuesday that condemned the bellhop politics he said are motivating New York Citys resistance to Airbnb.. Members of city council are nothing more than bellhops for the big hotel corporations. And its no surprise this type of bellhop politics has produced a process that has yielded bad legislation that at the end of the day is going to hurt everyday New Yorkers, Lehane said.. Airbnb executives held a conference call on the eve of a Wednesday City Council vote on legislation designed to rein in illegal hotels, or rentals under 30 days where the homeowner is not present. Airbnb expects the bill will further squeeze the online hospitality marketplaces tenuous grasp on its largest market when it passes - and it likely will.. The new legislation would force Airbnb to turn over names and addresses of its hosts to the Mayors Office of Special Enforcement. Failure to do so would result in fines up to ...

At 2-and-a-half-years-old, Rebecca was diagnosed with attention deficit disorder and bipolar disorder and was prescribed Zyprexas atypical cousin, Seroquel, along with Clonidine, an adult high blood pressure drug, and Depakote, a drug approved to treat adults with epilepsy. None of these drugs were approved for children and they were prescribed in a combination that has never been tested even with adults.. From age 2 on, Rebecca remained on this daily drug off-label concoction until she was found dead on the floor in her parents home on December 13, 2006. The autopsy report stated that she died of the combined effects of the drugs and that her lungs and heart were damaged by prolonged abuse of these prescription drugs, rather than one incident. Experts say, this case reinforces the assertion that judges have got to quit allowing drug makers to seal documents with court orders that show the side effects of drugs and the illegal conduct of promoting the sale of drugs for unapproved ...
Washington, DC - On January 31, 2019, United States Senator Elizabeth Warren (D-Mass.) sent an oversight letter to Acting U.S. Secretary of Defense Patrick M. Shanahan after public reports raised questions about his impartiality with respect to his former employer, Boeing, and its competitors, and after her office received a series of anonymous reports alleging that Acting Secretary Shanahan violated ethics rules by taking actions to promote Boeing in his current role at the Department of Defense. Such actions would represent a potential violation of ethics rules. In addition to sending a letter to Acting Secretary Shanahan, Senator Warren shared the whistleblower reports with the DOD Inspector General. Today, the DOD IG announced it has opened an ethics investigation into Acting Secretary Shanahans potential ethics violations, including his actions on behalf of his former employer, Boeing.. ...
More disturbing than his hearsay fantasy, is how it has evolved as he has garnished more and more attention from the 9/11 truth movement. At first what he heard was incomprehensible but pulsatile talk over the nearby radio. Now however, the man claims to have clearly heard a countdown to the collapse, which he claims intentional, of WTC7. Over the time his story has changed, Mr. McPadden has become a hero to the movement, talking before crowds, and interviewed for radio and websites. While one disadvantage of blogs is the potential lack of reliability, blogs however do allow in addition to the comments of its readers the posting of authentic internal or confidential documents that typically are not created to be viewed by the public, yet are acquired by certain bloggers. For example, blogger Dr. Peter Rost, a whistleblower himself, not long ago posted a newsletter published by pharmaceutical company AstraZeneca on his blog site, and this newsletter was given to him by AstraZenecas employees who called themselves the AZ Group of Seven- with the intent of this group being to bring to the attention of others the illegal activity of off-label promotion of one of AZs cancer drugs promoted by their employer. Yet this particular concern by AZ seven, by surprise, is not what caught the attention of so many who viewed the posted newsletter by Dr. Rost and was read with great interest by others. It was instead a comment included in this newsletter that was stated by former ...
MEXICO CITY (Reuters) - Mexico said on Wednesday said it had formally requested a report from U.S. authorities regarding alleged negligent practices in U.S. immigration detention centers, citing accusations of sexual abuse and unauthorized hysterectomies.. The request come after a complaint by a whistleblower nurse alleging that detainees in a Georgia immigration detention facility had improperly received hysterectomies and other gynecological procedures.. The complaint did not specify the nationality of the affected detainees. In a separate case, the Mexican ministry said its consulate in El Paso, Texas was in contact with a Mexican woman and her lawyer after an allegation of sexual abuse by U.S. Immigration and Customs Enforcement (ICE) agents.. It did not give more details. In August, ProPublica and The Texas Tribune reported allegations of a guard sexually abusing detainees including a Mexican woman at an El Paso immigration detention center. ICE at the time said the accusations would be ...

WASHINGTON The United States has intervened in a whistleblower suit accusing Renal Care Group Inc. (RCG) and Renal Care Group Supply Company (RCGSC) of fraudulently billing Medicare, the Justice Department announced today. The suit alleges that RCG and RCGSC fraudulently billed for supplies and equipment provided to End Stage Renal Disease (ESRD) patients who received dialysis treatments at home. Both companies are owned by Fresenius Medical Care Holdings Inc. which was also named in the lawsuit.. The government s complaint alleges that between January 1999 and December 2005, RCGSC submitted claims to Medicare for home dialysis supplies provided to ESRD patients for reimbursement of the supplies and equipment. All of these claims, as well as related claims for support services rendered by RCG dialysis clinics are alleged to be false because the defendants were prohibited from billing, and not qualified to bill Medicare for these home dialysis patients.. Under federal law, the Medicare program ...
The last twenty years have witnessed an astonishing transformation: the fight against corruption has grown from a handful of local undertakings into a truly global effort. Law occupies a central role in that effort and this timely book assesses the challenges faced in using law as it too morphs from a handful of local rules into a global regime. The book presents the perspectives of a global array of scholars, of policy makers, and of practitioners. Topics range from critical theoretical understandings of the global regime as a whole, to regional and local experiences in implementing and influencing the regime, including specific legal techniques such as deferred prosecution agreements, addressing corruption issues in dispute resolution, whistleblower protection, civil and administrative prosecutions, as well as blocking statutes. The book also includes discussions of the future shape of the global regime, the emergence of transnational compliance standards, and discussions by leaders of international
Even mainstream science is realizing the importance of the gut microbiome to autism and healthy child development.. Dr. Stephanie Seneffs autism research has focused on glyphosate, the active ingredient in Roundup, the most ubiquitous herbicide in the world. The side effects of autism, she found, closely mimic those of glyphosate toxicity. The steadily rising use of Roundup on American lawns and farms closely correlates to the rising tide of autism.. But the problem probably goes beyond glyphosate. You may recall our story on the CDC whistleblower who revealed the governments deliberate concealment of the link between the MMR vaccine (for measles, mumps, and rubella) and a sharply increased risk of autism, particularly in African American boys. Other studies now show a link between childrens exposure to pesticides and autism. Kids who live in homes with vinyl floors, which can emit phthalate chemicals, are more likely to have autism as are children whose mothers smoked. And the research now ...
It will allow any employee across levels and functions to anonymously report any safety lapses.. Indian Railways can be compared to a small country. Its 14 lakh employees exceed the population of Bahrain or Mauritius.. Managing such a large base of employees, spread across even the remotest parts of the country, can be a huge challenge. There could be a gateman sleeping on duty or a trackman not doing proper maintenance checks. The fact remains, that one small act of negligence can cost hundreds of lives.. To handle this massive workforce, which will also improve the safety levels of passengers, the Indian Railways is all set to launch a whistleblower website for its employees. It will allow any employee across levels and functions to report any safety lapses without revealing their identity.. Many a time employees refrain from reporting such incidents fearing backlash, which could cost their jobs.. ...

Ramirez Palma was ordered to be deported in 2016 and he lacks legal authorization to work in the U.S. He filed a stay of deportation earlier this year.. A letter addressed to William Joyce, the New Orleans field office director of ICE, on Nov. 27 urged the agency to release Ramirez Palma.. In the aftermath of a disaster of this scale, the public needs all available information to understand what happened at the worksite, including information from Mr. Ramirez Palma and workers like him who witnessed safety violations before the collapse, wrote Ava Dejoie, the secretary of the Louisiana Workforce Commission (LWC), per The Guardian. If he is deported, the public may never know what key information is being deported with him. The investigations will undoubtedly suffer.. CLICK HERE TO GET THE FOX NEWS APP. The commonest goal (85% of cases) was expansion of drug use to unapproved diseases (for example, gabapentin, which is approved for the treatment of specific types of epilepsy, was allegedly promoted as a therapy for patients with psychiatric diseases such as depression). The other goals were expansion to unapproved disease subtypes (for example, some antidepressant drugs approved for adults were allegedly promoted to pediatricians for use in children) and expansion to unapproved drug dosing strategies, typically higher doses. The researchers also identified four non-mutually exclusive types of marketing practices designed to achieve these goals. All of the whistleblowers alleged prescriber-related practices (including providing financial incentives and free samples to physicians), and most alleged internal practices intended to bolster off-label marketing, such as sales quotas that could only be met if the manufacturers sales representatives promoted off-label drug use. Payer-related practices ...

So does gender identity constitute a disability? Absolutely not. However, Judge Leesons ruling recognized a clear distinction between gender identity and gender dysphoria-the distress created by the differences between a transgender persons gender and the gender they were assigned at birth. Lets take a look at the facts of the case to figure out how he got there.. The case involves one Kate Lynn Blatt suing Cabelas Retail, her former employer, for firing her based on her diagnosed gender dysphoria. Ms. Blatt was not allowed to dress and act as woman while working for Cabelas. This became a point of contention between her and her employer. Under the ADA, an employer is required to provide reasonable accommodations to a disabled employee. However, Cabelas refused to let Ms. Blatt dress as a woman and allegedly eventually fired her over it. This led to Ms. Blatts ADA retaliation claim. A retaliation claim requires her to show that she engaged in protected activity under the ADA and that ...

James Clayton Solomon was convicted of violating the terms of his federal supervised release and agreed to voluntarily surrender, but instead absconded. Before he fled, Solomon sent a letter to the federal court stating his hope that Chief Judge Jimm Larry Hendren of the Western District of Arkansas dies a slow and painful death.. Solomon was apprehended in California and transported to a federal facility in Oklahoma. U.S. Marshal Susan Jones and a contract guard transported him back to Fort Smith, Arkansas. BEIRUT (AP) - Syria threatened Thursday to retaliate for an Israeli airstrike and its ally Iran said the Jewish state will regret the attack.
Spains profile on the global stage has grown under coach Jorge Vilda, who took over following the teams World Cup debut in 2015. The match may have been a confidence boost for No. 13 Spain , because it was able to hang with the worlds top-ranked team. He also warned against further tensions in the region and said tensions will have no achievements for any sides in the region.. We would love to be able to negotiate a deal if they want to. The advisors believe that these tensions will increase the threat of a war, which raises the pressure on President Trump.. Yet while Hezbollah relies heavily on Iranian funds and weapons, Saad says the relationship has become more of an alliance than proxy-patron, especially with the war in Syria.. In May, there was flutter about a reprisal of these talks, as Irans deputy foreign minister met the Omani Sultan and Japanese prime minister, Shinzo Abe, set up a visit to Tehran after a Tokyo summit with Trump. Iran is more inclined to resort to escalatory ...
Commentators have little doubt about the imminence of punitive strikes against the Assad regime, but are highly sceptical both about their moral grounds and their expected impact.. On Mandiner, Péter Bakodi suspects that the United States is wrong in asserting that the latest chemical weapons strike was ordered by the government forces. He believes it would have been foolish on Assads part to give such an order, when he knew that it would entail retribution by the United States. Only the opposition could benefit from that horrible incident, and it consists of extremely diverse groupings, some of which are extremist enough to resort to such methods. Bakodi adds that, all things considered, Assad is a factor of stability in the present Middle East turmoil, unlike his potential successors. Therefore he voices serious doubts about the wisdom of a Nobel Peace Prize winning US president embarking on the fourth - and least promising - war of his presidency.. On Komment.hu, József Makai also ...
The Supreme Court has been asked to weigh in on whether Medtronic is protected by preemption laws if if illegally promoted the Infuse bone growth system for off-label use.
The following are settlements reached against pharmaceutical companies to resolve allegations of off-label promotion of drugs. Under the Federal Food, Drug, and Cosmetic Act, it is illegal for pharmaceutical companies to promote their products for uses not approved by the Food and Drug Administration (FDA), and corporations that market drugs for off-label indications may be subject to civil liability under the False Claims Act as well as criminal penalties. Descriptions of the lawsuits are listed in chronological order. In 1996, whistleblower David Franklin left his position as a medical liaison with Parke-Davis, a pharmaceutical division of Warner-Lambert Company, after learning of the companys marketing strategy to promote the epilepsy drug Neurontin for uses not approved by the FDA. Franklin and his attorney, Thomas M. Greene, filed a lawsuit, Franklin v. Parke-Davis, under the False Claims Act in federal district court in Boston. In the first off-label promotion case ever litigated in a ...

WASHINGTON, D.C. - The recent account, by a licensed practical nurse-turned-whistleblower, regarding the treatment of detained immigrant women at Irwin County Detention Center in Georgia is beyond horrific - it is unconscionable and inhumane. According to the complaint, a number of immigrant women reported being recommended hysterectomies, with so many taking place, the whistleblower compared it to an experimental concentration camp. Many of these women underwent procedures, despite not being fully informed about the impacts - including the inability to later become pregnant. On top of this, the complaint further detailed the mishandling of the pandemic health threats at the facility, which is operated by a private prison company. Those who dared to speak out against these conditions were put into solitary confinement. NOW renews the urgent call of our Unlock the Future for Immigrant Women and Girls campaign for real reform to the abusive immigration practices, ending the current detention ...
He enthusiastically signed on to warrantless wiretapping, renditioning, the Patriot Act, prison abuse, detention without trial, violations of habeas corpus, and disgustingly invasive airport security measures. He deported immigrants more than Bush did. He increased funding for the drug war in Mexico. He invoked the Espionage Act more than all previous presidents combined, tortured a whistleblower, and claimed the right to unilaterally kill any U.S. citizen on Earth without even a nod from Congress or a shrug from the courts. The left-liberals who stand by this war criminal and Wall Street shill have made their choice: better to have the militarism and police state, so long as it means a little more influence over domestic politics, even if that too is compromised by corporate interference, than it is to embrace a radical antiwar agenda that might complicate their domestic aspirations. Our critics complain that America has moved to the right in the last three decades, and that would supposedly ...
CIA whistleblower John Kiriakou has revealed new details about the CIAs internal debate over the arrest, rendition and torture of Canadian citizen Maher Arar. Kirakou told The Canadian Press news agency numerous colleagues warned against arresting Arar, saying he was innocent. But Kiriakou said an unnamed female officer insisted on pressing ahead, saying Arar had links to al-Qaeda. Arar was arrested at New York Citys John F. Kennedy International Airport in 2002, while traveling through to Canada after a family vacation. He was sent to Syria, where he spent nearly a year being tortured, interrogated and imprisoned in a grave-like cell. Canada formally apologized to Arar and paid a $10 million settlement after an inquiry found he was totally innocent. But the United States, which was responsible for his rendition, has never apologized. Kiriakou, meanwhile, remains under house arrest after revealing the identity of a covert officer to a reporter who did not publish it. Kiriakou exposed the ...
Did Merck Unfairly Monopolize the Market for a Mumps Vaccine? September 10, 2014, Wall Street Journal blog http://blogs.wsj.com/pharmalot/2014/09/10/did-merck-unfairly-monopolize-the-market-for-a-mumps-vaccine/ Did Merck use false pretenses to monopolize the market for mumps vaccines? A pair of lawsuits one of which is filed by former employees and the other by doctors make this allegation and a federal judge is allowing both claims to proceed. The former employees virologists who filed a whistleblower lawsuit four years ago charge Merck knew its vaccine was less effective than the purported 95% efficacy level. And they alleged that senior management was aware, complicit and in charge of testing that concealed the actual effectiveness. They claim to have witnessed fIrsthand what they describe as improper testing and data falsification in which Merck engaged in order to conceal what the drug maker knew about the vaccine s diminished efficacy. In fact, their Merck superiors and senior management ...
Source - Bloomberg. Citigroup ignored warning signs of Bernard L. Madoffs Ponzi scheme, and a bank executive knew the con mans stated trading strategy couldnt generate the reported returns, the trustee liquidating Madoffs firm said in a lawsuit.. The unidentified Citibank executive, who was responsible for making recommendations to clients on derivatives, concluded by June 2007 that returns reported by a Madoff feeder fund, Fairfield Sentry Ltd., couldnt have come from the strategy, trustee Irving Picard said in a complaint unsealed yesterday. The executive reached his conclusion after meeting with analyst Harry Markopolos, a whistleblower who also alerted U.S. regulators to the fraud, Picard said.. The Citibank official later communicated with Markopolos orally and in writing, specifically discussing the fraud before the Ponzi scheme was exposed in December 2008, Picard alleged.. Citi knew, and was on notice of, irregularities and problems concerning the trades reported by BLMIS, and ...

pet and play with the tigers.. The NatGeo investigation was based, in part, on information provided in a report by the Australian animal welfare group, Cee4Life. The report includes videotaped evidence from a whistleblower codenamed Charlie that three micro-chipped male tigers were trafficked from the temple in December 2014 with the full knowledge of the temples founder and leader, Abbot Phra Acham Phoosit (Chan) Kanthitharo. (Read EIJs article on this issue, which includes an interview with Cee4Life founder Sybelle Foxcroft, here.). Though Cee4Life made its report public last Friday (January 22), it had turned its findings over to Thai authorities (and to NatGeo) back in December.. The Thai Department of National Parks, Wildlife and Plant Conservation has been trying to remove the tigers from the temple for weeks, but the monasterys socio-cultural standing and deep political influence seems to be proving a major roadblock in this regard. Board members at the temple have included a Thai ...

A number of Israeli politicians and lawmakers said that Israel had to use the revelations of US spying to press Washington to free jailed Israeli agent, Jonathan Pollard, a spy jailed for passing classified material to Israel while working as a US Naval intelligence analyst. He revealed information that Iran, Syria, Iraq and Libya were busy developing weapons of mass destruction to attack Israel. The whistleblower pleaded guilty and received a life sentence in 1987. In 1995 Israel granted him citizenship, and has lobbied for his release since then. Pollard has already spent nearly 30 years in a federal prison, an all-time record, as no one in US history has ever been given a life sentence for a similar offense, whose average time is usually between two and four years ...

According to Favorito, an IT professional, the fraud was very widespread, and whistleblowers who exposed it are being persecuted, while co-conspirators who helped are being rewarded. The situation is dire and urgent, and the president must act, Favorito says.. ...
The use of social means to engage in defamation is nothing new. Indeed, defamation requires the very social element of publication. Social media - Facebook pages or posts, tweets, blogs and online comments - merely make defamation easier and more pervasive.. Canadian courts have struggled to balance the interests of free speech with the interests of individuals who wish to challenge and find redress for defamatory statements. A recent Ontario case has framed the issue as follows:. There are few things more cowardly and insidious than an anonymous blogger who posts spiteful and defamatory comments about reputable member of the public and then hides behind the electronic curtain provided by the Internet. The Defendant confuses freedom of speech with freedom of defamation. There are, undoubtedly, legitimate anonymous Internet posts: persons critical of autocratic or repressive regimes, for example, or legitimate whistleblowers. The Defendant is not one of those people. The law will afford his ...
