The most important preventive measures in occupational health care are maintaining workability, sufficient early treatment, and timely rehabilitation.. But if work disability becomes protracted, occupational health care can help employees return to work after sick leave by adjusting the workload to ensure that a returning employee can carry out their job safely and effectively. This requires close cooperation between employees, employers and occupational health care professionals.. In June 2012, legislation took effect whereby the remaining workability of employees must be assessed by occupational health care after 90 working days of sick leave at the latest. Employers, employees and occupational health care professionals must consider how return to work can be best facilitated, for instance by making working times more flexible.. For more on occupational health care see the section on Occupational Health service. ...

We are often asked whether post-accident fixes or improvements by an employer will be held against it if occupational health and safety charges are laid. For example, if an employer puts a guard on a machine after an employee was injured on the machine, will the court see the installation of the guard as an admission that the machine was not properly guarded?. Employers sometimes feel that they are caught between implementing the fix and risking having it be seen as an admission of liability, or not implementing the fix and risking a higher fine if convicted or being charged with violating a government order to fix the machine. Of course, most employers will be motivated to do what is right and install a fix if needed for safety reasons, regardless of whether that increases the risk of charges or fines; however, the possible risks should be considered. In some cases, quick implementation of the safety fix could actually help avoid charges.. It appears from the caselaw that post-accident safety ...

Hi I was interested to read a report where the HSE are prosecuting a Traffic Management firm from Newcastle after the death of two of its employees and offer this as a discussion topic. Sorry its such a long post. At the original trial in Teesside the company argued a defence that what happened could not have been foreseen, that the contributory actions by the employees were outside their remit and contrary to warning signs posted. The HSE said that unforseeability is irrelevant and that the company should have taken steps to protect employees against unforeseen risks, and set out against reg 21 of the management of Health and Safety at Work Regulations 1999, will not afford an employer a defence. The Judge in his preliminary findings ruled that evidence of forseeability is admissible when considering what is reasonably practicable for the purposes of discharging duty under Sect s2(1) HSAWA and that reg 21 HSWR does not preclude a defendant advancing evidence of any act or default of...
