The two basic weaknesses of the local government structure are the number and variety of special-purpose authorities and the excessive number of territorial authorities. The special-purpose authorities in general are subject to a considerable degree of direction by the Central Government. Moreover, they exercise functions which in some instances at least might otherwise be exercised by territorial authorities, especially if the territorial structure was strengthened by amalgamation of smaller and weaker units. The excessive number of territorial authorities means that some of them are too small and consequently have inadequate resources, a fact which limits their ability to perform satisfactorily the functions demanded by a rapidly growing community and expanding economy, at least without substantial financial assistance by the Central Government. Last month, the Washington State Auditors Office (SAO) issued a special report about local governments that do not file their annual financial reports. The report found that 611 local governments did not file their financial report with SAO in 2013.. In response to that report, Rep. Ross Hunter (D-Medina) is sponsoring HB 2084, which imposes fines and withholds taxes to certain local governments who fail to file their annual financial reports with SAO.. Most of the proposal applies only to special purpose districts, and it specifically excludes cities, towns, and counties. The cases 20-year history and rather unique facts make it challenging to adequately characterize here. Nonetheless, it is important to consider the case as it holds potential to be either very broadly or very narrowly construed as precedent for future cases. In Rotonda, a private developer installed a water and sewer system as a condition of the state for a development permit and as part of a prohibition on use of any septic systems.
