Following an application from Vifor Ltd, submitted for authorisation of a health claim pursuant to Article 14 of Regulation (EC) No 1924/2006 via the Competent Authority of the United Kingdom, the EFSA Panel on Dietetic Products, Nutrition and Allergies (NDA) was asked to deliver an opinion on the scientific substantiation of a health claim related to Equazen eye q® and improving reading ability. The Panel considers that Equazen eye q®, a combination of eicosapentaenoic acid (EPA), docosahexaenoic acid (DHA) and gamma-linolenic acid (GLA) (at a weight ratio of 9:3:1), which is the subject of the health claim, is sufficiently characterised. Improving reading ability is a beneficial physiological effect. The applicant provided four human intervention studies that investigated the effect of Equazen eye q® on reading ability in children. No conclusions can be drawn from three of these studies for the scientific substantiation of the claim. The fourth study does not show an effect of Equazen eye q ...
The Problem of Absoluteness-Relativeness of Scientific Cognition and The General Method of Substantiation. A. Voin Abstracts It is considered phenomena of science, which gave birth to the problem and which the analytics (the logic positivists) tried unsuccessfully to overcome and the post positivists used them for substantiating their conclusions about relativeness of scientific cognition. The general method of substantiation, which rational science uses to substantiate its theories, is expounded. It is shown, that this method is unchangeable through changing of scientific paradigms, substantiating layers and so on. Possessing by science of this method divides it from non-science and pseudoscience and provides its especial epistemological status. On base of this method, rational explanation of above mentioned phenomena of science is given, and argumentation of the post positivists is refuted. Does difference between science and non-science exist in principle and if it does, what is it? Does ...
Following an application from Specialised Nutrition Europe (formerly IDACE), submitted pursuant to Article 14 of Regulation (EC) No 1924/2006 via the Competent Authority of France, the EFSA Panel on Dietetic Products, Nutrition and Allergies (NDA) was asked to deliver an opinion on the scientific substantiation of a health claim related to iodine and contribution to normal cognitive development. The food constituent, iodine, which is the subject of the health claim, is sufficiently characterised. Contribution to normal cognitive development is a beneficial physiological effect for infants and young children. A claim on iodine and contribution to normal cognitive and neurological function in the general population has already been assessed with a favourable outcome. In addition, there is a large body of evidence indicating a crucial role for iodine in growth and development. The Panel notes the well established role of iodine in preventing iodine deficiency disorders such as retarded mental and ...
TY - JOUR. T1 - Validation of a modified PCR-based method for identifying mutant restricted ovulator chickens. T2 - Substantiation of genotypic classification by phenotypic traits. AU - Elkin, R. G.. AU - Zhong, Y.. AU - Porter, R. E.. AU - Walzem, R. L.. PY - 2003/4. Y1 - 2003/4. N2 - Upon photostimulation, restricted ovulator (RO) female chickens exhibit endogenous hyperlipidemia, develop atherosclerotic lesions, and generally fail to lay eggs. This phenotype results from a point mutation in the gene specifying the very low density lipoprotein receptor (VLDLR), whose protein product normally mediates the massive oocytic uptake of egg yolk precursors from the circulation. Taking advantage of the single base change in the mutant VLDLR allele, a PCR-based method for the rapid identification of RO chickens was developed at the Biocenter and University of Vienna, Austria. However, this procedure was incompletely validated because phenotypic data were not obtained and conventional progeny testing of ...

1 & 2. Upheld. The ASA asked Medical Thermal Imaging to supply robust clinical evidence to support the claim that their product could detect abnormalities before mammography and that it was medically recognised. This information was not supplied.. Because the advertiser did not provide robust evidence to substantiate the claim that thermography could detect active breast abnormalities which also compared its efficacy with mammography or that it was medically recognised, we concluded the ad was misleading.. The ad breached CAP Code (Edition 12) rules 3.1 3.1 Marketing communications must not materially mislead or be likely to do so. The Agency was created in 2001 based on a report by Professor James,[3] issued after several high-profile outbreaks and deaths from foodborne illness. It was felt that it was inappropriate to have one government department, the Ministry of Agriculture, Fisheries and Food, responsible for both the health of the farming and food processing industries and for food safety. Uniquely for a UK Government department, the Food Standards Act gave the Agency the statutory right to publish the advice it gives to Ministers - and as a signal of its independence it declared that it would invariably do so. From its inception, the Agency declared that it would take no decisions about food policy except in open Board meetings accessible to the public. Since 2003, these meetings have been webcast live, enabling consumers to see the decision-making process in action. Each Board meeting concludes with a Q&A session in which web viewers can question the Board or its Executive directly. In 2006, the Wine Standards ...
The American sweets at Hopscotch are genuine imports. As such, most were destined for the US domestic market and the food labelling reflects this.. The requirements of the US Federal Food & Drug Administration (FDA) differ to our EEC food regulations. We endeavour to ensure that the sweets sold at Hopscotch contain permitted EEC levels of food additives and colours. However, the US labelling does not comply with EEC and UK Foods Standards Agency regulations.. In particular, many of the sweets here contain colours that may have an adverse effect on activity and attention in children. These are:. ...

Tom Price discovered a boulder containing gold on a visit to the area in 1906.[5]:8. In 1911, important claims were made along the Main Break. John Hunton staked claims on 18 Feb. 1911, which were incorporated as the Hunton Gold Mines Ltd. in April 1914, eventually becoming part of the Amalgamated Kirkland. Stephen Orr filed claims on 22 Feb. 1911, the basis for the Teck-Hughes Mine and the Orr Gold Mines Ltd, which was incorporated in June 1913. George Minaker staked claims on 23 Feb. 1911, part of which he sold to Oakes in Sept. 1912, becoming part of the Lake Shore Mine. John Reamsbottom filed claims on 18 April 1911 which became part of the Teck-Hughes Mine. C.A. McKane staked claims on 20 April 1911, which became the Kirkland Lake Gold Mine. A. Maracle staked claims on 5 June 1911 which became part of the Townsite claims. Melville McDougall staked claims on 27 June 1911, which he transferred to Oakes on 6 Sept. 1912, and became the part of the Lake Shore Mine. Jack Matchett staked a claim ...
Desai: Claim substantiation is a very powerful theory, based on FTC standards. Standard isnt just we think it; can require certain kinds of tests. He had one case where someone paid for a 30-person test and market research and said that proved the product caused weight loss. Our claim: we are not acting on behalf of the FTC, but litigating under the UCL. We arent saying we need the same level of proof, but rather saying that under California (as well as NY and some other states) law the standard isnt deception but rather likely to deceive, a much lower standard, and thats where we try to get in this idea of lack of substantiation. (Ok, I think I see the conceptual disconnect here. Ps really need to be making the Lanham Act move of identifying the necessarily implied claim of substantiation--which is a straight-up false message received by a consumer as a result of her receipt of the explicit scientific-sounding claim--rather than just saying the scientific-sounding claim is ...

ADR Substantiation: Drug safety issues pose serious health threats to the population and constitute a major cause of mortality worldwide. Due to the prominent implications to both public health and the pharmaceutical industry, it is of great importance to unravel the molecular mechanisms by which an adverse drug reaction can be potentially elicited. These mechanisms can be investigated by placing the pharmaco-epidemiologically detected adverse drug reaction in an information-rich context and by exploiting all currently available biomedical knowledge to substantiate it. We present a computational framework for the biological annotation of potential adverse drug reactions. The proposed framework seeks to provide a biological explanation (signal substantiation) by exploring mechanistic connections that might explain why a drug produces a specific adverse reaction. The mechanistic connections include the activity of the drug, related compounds and drug metabolites on protein targets, the association ...
This paper deals with the substantiation that a multivariate response self- or trace-driven simulation model, within its domain of applicability, possesses a satisfactory range of accuracy consistent with the intended application of the model. A methodology is developed by using simultaneous confidence intervals to do this substantiation with respect to the mean behavior of a simulation model that represents an observable system. A trade off analysis can be performed and judgement decisions can be made as to what data collection budget to allocate, what data collection method to use, how many observations to collect on each of the model and system response variables, and what confidence level to choose for producing the range of accuracy with satisfactory lengths. The methodology is illustrated for self-driven steady-state and trace-driven terminating simulations. ...

At least 700,000 eggs implicated in the fipronil scandal have been imported into the United Kingdom, far more than initial estimates, the Food Standards Agency has confirmed.. The Food Standards Agency said products affected in the United Kingdom were mainly processed foods in which egg is one ingredient among many others, mostly used in sandwich fillings or other chilled foods.. In France, about 250,000 affected eggs have sold in the country since April and authorities say products containing eggs from contaminated farms will be taken off the shelves. While some European countries eggs containing Fipronil residues have been sold as fresh eggs, this is not the case in the UK.. This is more than 33 times the 21,000 first estimated, the Food Standards Agency has said.. The U.K. raised its estimate of eggs contaminated by the unauthorized pesticide fipronil, with the outbreak believed to have affected some products made by major supermarkets.. Almost 250,000 eggs contaminated with an insecticide ...

Then CSPI shifted their attention to the media: The dietary supplement industry is full of snake oil salesmen, CSPI executive director Michael F. Jacobson told The Daily News. Its frustrating to see so many deceptive claims for dietary supplements. CSPI is threatening to sue Bayer over their One a Day line of nutritional supplements. They say Bayers health claims [fail to] satisfy the FTCs requirements for substantiation in order to be lawful. The FTC has recently required a higher standard of proof for companies making health-related claims. Unfortunately, media outlets as august as The New York Times gobbled up the story. However, the FTC required a higher standard of proof for only those few companies, and enforced that standard via litigation and a consent decree for each company. Its not a regulation that applies to every company, much to the disappointment of FTC and apparently CSPI-but it is a deeply troubling precedent. ...

An interesting approach to documentation and sourcing. You accept a hypothesis (in this case that Ronald Reagan ended the Cold War), then refuse to tolerate any alternative explanations, no matter how well grounded. You claim that such liberal views require substantiation, and yet, when substantiation for them is offered, you excise the substantiation altogether. Ill note that no documentation whatsoever is offered in support of the hypothesis that Reagan brought the end of communism in Eastern Europe. I should add that liberal is a very misleading and damning characterization of these views, since the thesis that Reagan wasnt responsible for the fall of communism derives more from any number of factors in which Reagan had no bearing whatsoever. The references provided and then unceremoniously removed without explanation explain these in more detail. For instance, Jan Kubiks work on the emergence of civil society and Solidarity in Poland shows how important the Catholic Church and ...
On October 31, 2000, the Food and Drug Administration responded to the third of four proposed health claims for dietary supplements that were the subject of the infamous Pearson decision with a new twist in the health claims arena: a qualified health claim approved solely for a dietary supplement, and thus far only for the alleged relationship between omega-3 fatty acids and coronary heart disease (CHD). The case of Pearson and Shaw v. Shalala challenged FDAs 1993 decision to deny four health claims: antioxidant vitamins and certain cancers, omega-3 fatty acids and CHD, fiber and colorectal cancer, and dietary supplements as a superior source of folic acid for reducing the risk of neural tube defects. Ultimately, the U.S. Court of Appeals for the D.C. Circuit found for the plaintiffs and directed FDA to reconsider authorization of these claims; further clarify the significant scientific agreement standard it requires for authorization of new health claims, and consider whether health ...

The new FDA research study by Brenda M. Derby and Alan S. Levy, which does not reflect an official agency position, found that written qualifications expressing scientific uncertainty failed to significantly reduce consumer confidence in questionable health claims. By contrast, a report card style graphic may successfully communicate some distinctions in levels of scientific certainty. Unfortunately, however, a report card with a B or C rating seemed to increase consumer confidence in the health claim by comparison with no report card at all -- even though having no report card means the claim meets FDAs stronger standard of significant scientific agreement. The authors speculated that the qualified health claims report cards might work better if the graphic appeared on all products with health claims, even those that rate an A ...

The new Good Manufacturing Practice regulations for dietary supplements require that manufacturers with shelf life statements on their labels have appropriate scientific substantiation. However, expiration dates are not required by the rule, and the cGMPs released in June provide little to no guidance as to what qualifies as scientific substantiation. Manufacturers are left wondering whether it is in their best interest to provide a shelf life statement and, if so, what the appropriate testing programs are for substantiating shelf life - a daunting and difficult task for manufacturers and marketers of herbal products. To help manufacturers and marketers comply with GMPs, the American Herbal Products Association offers an information-packed tele-seminar, Shelf Life Statements on Dietary Supplement Labels.. Youll have a chance to gain regulatory, legal and scientific insight from these knowledgeable speakers:. ...

from wikipedia: Junk foods typically contain high levels of calories from sugar or fat with little protein, vitamins or minerals. Foods commonly considered junk foods include salted snack foods, gum, candy, sweet desserts, fried fast food, and sugary carbonated beverages. [5] Many foods such as hamburgers, pizza, and tacos can be considered either healthy or junk food depending on their ingredients and preparation methods with the more highly processed items usually falling under the junk food category. By Riëtte van Laack -. As previously reported, on Dec. 8, 2010, FDA published a proposal to amend the interim final rule (IFR) governing health claims concerning the risk of cardiovascular heart disease and consumption of phytosterols (see 21 C.F.R. § 101.83). FDA stated that, as of February 22, 2011, it intended to discontinue its policy of enforcement discretion that had been in effect since 2003 concerning certain health claims that go beyond the IFR. Based on comments and petitions by industry contending that more than 75 days were needed to relabel and reformulate products (see our prior post here), FDA decided to extend the 2003 enforcement discretion policy until February 21, 2012. FDAs decision does not constitute a response to the petitions it received in response to the proposed rule. ...

On March 29, 2018, FDA announced the Nutrition Innovation Strategy, which signaled their intention to take a fresh look at what can be done to reduce the burden of chronic disease through improved public nutrition. The agency wants to facilitate consumers making better food choices to improve their health. At the same time, FDA has acknowledged that in many cases, changes in food processing technology has rendered outdated certain provisions of the regulations once written to both inform and protect the public. Therefore, FDA has developed a plan to move ahead to update its policy toolkit.. This multi-pronged approach includes modernizing food labeling, including food standards, health claims policy, ingredient labeling requirements and continuing implementation of the updated nutrition facts label, menu labeling, and reducing sodium in processed food products.. In particular, in trying to gather information to help determine the best approach to revising food standards of identity, FDA held a ...

Thats from the New York Times. Anyone who believes that Congress will actually manage to ban junk food from schools-including junk food from vending machines-should save their optimism for Powerball or some other reasonable venture. Back in May of 2004, Sen. Tom Harkin (D-IA) introduced a measure that would merely develop nutritional guidelines for school vending machines. Guidelines. Thats all. But no. Four Democrats sided with eight Republicans to defeat the measure. Is the junk food lobby really that powerful? Consider the evidence: In June of 2005, Connecticut Governor Jodi Rell vetoed a bill that wouldve rid Connecticut schools of junk food, despite widespread parental approval. Guess who opposed the measure? Two months earlier, Kentucky had just barely managed to squeak out a bill that banned soda from elementary schools-anything more stringent would never have passed. Arizona had to make the same compromise in April. Members of Congress who oppose federal regulations on junk food ...

Health claims on food labels are claims by manufacturers of food products that their food will reduce the risk of developing a disease or condition. There are a variety of classifications for fiber, such as soluble and insoluble, viscous and nonviscous, and while all fiber seems to possess some cholesterol-lowering properties, certain types might be more effective than others. You can have oats in the form of instant oats, which cook faster. Oatmeal contains soluble fiber, which reduces your low-density lipoprotein (LDL) cholesterol, the bad cholesterol. Thus, both grains donâ t cause a major spike in blood sugar after consumption. Oatmeal contains a balanced soluble and insoluble fiber, which reduces your low-density lipoprotein (LDL), the bad cholesterol.
