Guardianship - Victorian Law Reform Commission
Those whose decision-making ability is impaired sometimes need a guardian appointed to them. Although Victoria has been an Australian and world leader in guardianship law, social changes in this area have been rapid. In particular, in an aging population, guardianship laws originally designed for the care of children may not be appropriate for the many older people who now rely on guardians.. In May 2009, the Attorney-General asked the Commission to review the Guardianship and Administration Act 1986 (Vic) and report on whether changes were needed.. In January 2010, the Commission published an information paper that explained the operation of the laws in Victoria. A consultation paper published in February 2011 described how Victorias guardianship and administration laws currently operate, outlined problems with these laws, discussed laws in other jurisdictions, and put forward options for reform.. This reference required extensive community consultation to understand the day-to-day realities ...

The DD News Blog: Legal Guardians: HCBS rule confirms decision-making authority
The federal Home and Community Based settings rule places the individual with a disability at the center of a Person Centered Planning process. This is as it should be, allowing for the reality that many people with intellectual and developmental disabilities are limited in their ability to make or communicate decisions for themselves or to exercise their rights on their own behalf and for whom legal guardianship may be necessary. With my own sons, who have profound physical and intellectual disabilities this is certainly the case. Were my husband and I not able to represent their interests through the authority that we have as legal guardians, they would be continually at the mercy of whomever was in control of a particular situation - group home staff, a community mental health agency, the provider agency that staffs the group home, medical personnel, etc. We include in this group some disability advocates who claim to know our sons needs better than we do. Some even claim that it is possible ...

conservator vs guardian
Conservatorship vs. Guardianship - Understanding the Terminology The first thing you need to understand is the legal terminology used by the various states. The two roles are similar but distinct. However, with a conservatorship, the person needing care is an adult who is either physically or mentally unable to handle his or her own affairs. With that in mind, conservatorship generally has to do with managing someones financial affairs on their behalf. The person whose well-being the guardian is responsible for is called a ward. The conservator takes care of real estate, manages bank accounts, and handles investments. Conservator. This type of guardian has limited powers that are detailed in the appointment. The process for becoming a conservator or guardian for someone else can also vary. The person whose well-being the guardian is responsible for is called a ward. Leave a Comment. Reprinted from: The Bulletin, published by the New York State Psychiatric Association, Area II, Vol. 37, No. 6, May-June, 1995.. www.sangerman.com. (Click here for New York Rules for Fiduciary Appointments). Effective legal representation under the New York guardianship statute generally necessitates the close working relationship between an attorney and a psychiatrist. Article 81 of the New York Mental Hygiene Law (Article 81) replaced the old conservatorship and committee proceedings effective as of April 1, 1993. The raison detre of the new statute was that the conservatorship and committee statutes did not provide the flexibility necessary to meet the diverse and complex needs of persons with incapacities. Conservatorships, which dealt with financial management only, generally were insufficient to provide necessary relief. On the other hand, a committee, with its judicial finding of incompetence and the accompanying stigma and loss of civil rights, involved a deprivation that was often ...

Lies of Michael Schiavo
Posted on 10/12/2004 10:17:22 AM PDT by amdgmary. Dear Friends of Terri: On October 20, 2003, Michael Schiavo offered his comments about Terri in an article published by the Tampa Tribune. I have compiled a review from Terris medical records of how the facts were actually stated by Terris health care providers versus the false statements made by Michael Schiavo. What you are about to read depicts the lies from Terris estranged husband as he has consistently portrayed them in the Florida courts in order to rationalize HIS desires to cease all of Terris therapies and to remove her feeding tube and have her die by starvation and dehydration. I warn you that what you are about to read is not only sad, but extremely tragic. Every day that Terri is forced to remain under the guardianship of Michael Schiavo, she is deprived of the many available therapies due her and her life remains in constant jeopardy. As a Registered Nurse, patient advocate and friend of Terri, I ask you to please join me in my ...

One of the fundamental questions of all societies is the possible trade-off between quality of outcomes and equality of opportunity. The question of a possible trade-off between equality of opportunity and level of outcomes has a long history in the sociology of education, and it has been seen as a fundamental question of the field. Economics literature recognises that equality of opportunity is not, unlike equality of outcomes, in a trade-off with quality of outcomes. Rather, inequalities of opportunity generate inefficiency and are thus in a trade-off with the level of outcomes. Here, building on this difference, we make a distinction between outcome trade-off and opportunity trade-off. Equality of opportunity is standardly measured indirectly, taking outcomes associated with circumstances to be due to circumstances and thus an indication of inequality of opportunity. This approach assumes that the circumstances of the individual are independent of the responsibility characteristics. The ...

Childrens Fund 11/07/2019 | Lakewood Ranch Womens Club
The Childrens Guardian Fund partners with the Guardian ad Litem program to give these kids a much needed voice and an opportunity to change their lives with the assistance of volunteer advocates (guardian ad litems) who help them thrive and develop a sense of self-worth.. These volunteers meet with the children at least once a month to make sure they are going to school and getting proper medical care, and they provide things those who are living in a traditional, stable family environment receive routinely such as after school programs, new clothes, tutoring, etc.. The guardians will appear before a judge in family court and advocate for what they feel is best for the children, the ultimate goal of which is to be reunited with the family. Members were shocked to learn there are over 1,500 children in these three counties alone, and the sad fact is there are only 582 guardian ad litems serving this very large number.. A guardianship hearing for Tyler Cairus, an 18-year-old autistic Monett man being held in the Barry County jail, is set for Friday at 11:15 a.m. at the Judicial Center in Cassville.. Wendy Cairus said the case against her son has put her in a tough position, as she has been advised by her attorney to not pursue guardianship.. It puts me in an awful position because I was told not to take guardianship because I would be liable for all of the bills for keeping him in Fulton for six months, she said. I dont understand the legality of it all, and I dont want to give up my rights, but it would put me so far in debt.. Tyler Cairus, who is being held on a $100,000 cash-only bond, was arrested on charges of attempted statutory sodomy and attempted statutory rape after an incident at Monett Elementary School. National Association to Stop Guardian Abuse: 2012-02-19
In the U.S.A. there has been a growing problem of abuse of the elderly and disabled due to a covert system of guardianship or conservatorship. This covert system of power and control is enforced through the judicial system. It is manipulated for use by fraudsters, abusers and persons wielding undue influence for financial advantage. The wards have lost the right to complain, because they have been stripped legally of all their rights, left defenseless and subject to exploitation by the very people chosen to protect them; they are now invisible and voiceless. There is a growing trend for the courts to appoint total strangers who do guardianship duties as a business for profit. The for-profit guardian is appointed to take over the decision making process and often times given total and absolute control over the life, liberty and property of their wards ...

National Association to Stop Guardian Abuse: 2016-11-20
Virtually every day of the week, in every state, an elderly individual with sizable assets is targeted by a professional, for-profit guardian. Claiming the victim is [incapacitated], these parasitic predators then petition for guardianship. The proof of incapacity? Most likely does not exist. The predatory guardian simply has to claim to the probate tribunal administrator, that there is incapacity of some kind. They do not have to provide any proof, no evidence of any kind to substantiate their claim. After all, there is an estate to be exploited and no one is allowed to stop the transfer of wealth that is about to take place. The predator guardian will most likely resign from a case as soon as the estate has been totally depleted and the assets totally converted to their personal accounts ...

Alzheimers Research UK funds new dementia study
Dr Giordano Pula from our Department of Pharmacy & Pharmacology has just been awarded £29,000 by Alzheimers Research UK to study vascular complications of Alzheimers disease.. The study, funded by the UKs leading dementia research charity, aims to understand how blood cells and blood vessels can be affected during the disease and to shed light on why people with Alzheimers also seem more prone to vascular problems, such as stroke. The work will be carried out in collaboration with Dr Ilaria Canobbio and Professor Mauro Torti from the University of Pavia (Italy).. A hallmark feature of Alzheimers disease is the build-up of a protein called amyloid in the brain. As well as building up between nerve cells, amyloid is also present in blood and, in some cases, can build up inside blood vessels. There is evidence that amyloid could trigger blood cells called platelets to behave abnormally. This could cause complications like inflammation and clots and drive the disease to get worse.. Dr Pula ...

Terri Schiavo case - Wikipedia
The Terri Schiavo case was a right-to-die legal case in the United States from 1990 to 2005, involving Theresa Marie Terri Schiavo (/tɛriː ˈʃaɪvoʊ/; December 3, 1963 - March 31, 2005), a woman in an irreversible persistent vegetative state. Schiavos husband and legal guardian argued that Schiavo would not have wanted prolonged artificial life support without the prospect of recovery, and elected to remove her feeding tube. Schiavos parents disputed her husbands assertions and challenged Schiavos medical diagnosis, arguing in favor of continuing artificial nutrition and hydration. The highly publicized and prolonged series of legal challenges presented by her parents, which ultimately involved state and federal politicians up to the level of President George W. Bush, caused a seven-year delay before Schiavos feeding tube was ultimately removed. On February 25, 1990, Schiavo sustained a cardiac arrest at her home in St. Petersburg, Florida. She was successfully resuscitated, but had ...

Contrary to media claims that Schiavo is comatose or in a persistent vegetative state, Santorum said, the 41-year-old disabled woman is close to equivalent of someone with the disease cerebral palsy. Senate Democrats are expected to resist the proposed legislation, which would give federal courts jurisdiction over Schiavos case, though experts predict that, unless someone intervenes, her death will be gruesome. After her feeding tube is removed, she will experience significant pain and psychological distress during the two weeks it is expected to take her to ...
The Terri Schiavo Case - John Wright
On February 25th, 1990, Terri Schiavo collapsed at her Florida home from what doctors said was a potassium imbalance, possibly caused by her bulimia. Her brain did not receive oxygen for around five minutes and the effect of that deprivation caused severe brain damage. Doctors seem to have disagreed over the extent of that brain damage; the doctors hired by her husband have said that she is in a persistent vegetative state (PVS), without the ability to think, speak or respond to commands and without being aware of her surroundings. Doctors hired by Terri’s parents, meanwhile, have said they believe she could improve with therapy. But her husband Michael gave up on therapy after years of trying, and she has not received physical therapy for more than a decade now. Her parents contend that, when she was receiving such therapeutic care, she uttered a few one-syllable words, although sounds from those in a PVS that could seem like words are not uncommon, which is also true with motions such ...
Worcestershire fundraiser bags money for Alzheimers | Alzheimers Research UK
A founder member of the Charity Fairs Association, Charlotte explained her motivation for supporting the Alzheimers Research Trust: I was inspired by Terry Pratchetts announcement that he has a form of Alzheimers and the fact that dementia research is hugely underfunded. I realised then that this is something that can affect any of us and I decided I wanted to do something to help.. I have designed a black patent-look bag, which Ive called simply The Charity Shopper. It has shoulder-length straps and a smart, wipe-clean purple lining. Not only is this limited edition all day bag strong and practical but anyone using it will feel good too, especially knowing that a substantial amount from every bag sold is being shared between three hugely deserving charities. The Charity Shopper bag costs £19.95 or two for £30.00 and the charities will receive £2.50 each from every bag we can sell between now and the end of May. Mental Health Act: Voluntarily Admitted Patients (14:VI) - Clicklaw Wikibooks
A person who refuses to sign the consent form may be deemed a patient who could not be cared for or treated appropriately in the facility under s 18(b) of the MHA. This person runs the risk of being refused admission to the facility or being discharged if already admitted. Under the Patients Property Act (PPA) hospitals could circumvent the issue of consent by seeking a court order, supported by two medical opinions, to have the patient declared incapable of managing their personal affairs. Minor changes were made to the PPA in September 2011. Under the PPA, a legal guardian or public trustee is appointed as committee to give consent for the patient. It is not sufficient for a family member to give consent for a voluntary informal patient without first obtaining legal guardianship or committeeship, or becoming a substitute decision maker under the HCCFA. A recent decision in Nova Scotia regarding guardianship found that some of the central provisions of the Incompetent Persons Act, R.S.N.S., ...

April 2016 - Treoir
Treoir is very disappointed that the section in the Act that gives authority to Birth Registrars to provide and witness Statutory Declartion Forms for Joint Guardianship (S.I. No. 5 1998) has not yet commenced. Treoir was very effective in influencing the inclusion of this piece of legislation in the Act. When implemented, not only will unmarried parents be provided with this service but this will ensure that unmarried parents are informed about their legal status at the point of registering the birth of their child. It is a commonly held belief that where a father has his name on his childs birth certificate he has automatic legal rights in respect of his child. This is not so.. Treoir campaigned strongly for the inclusion in the legislation of a Central Register of Guardianship Agreements (S.I. No. 5 of 1998). Treoir considers it in the best interests of unmarried parents and their children to have these Declarations, which contain evidence of very significant legal rights and ...
